Terms of Service

Welcome to BellaSublime. These Terms of Service ("Terms") govern your access to and use of bellasublime.ca (the "Site") and any purchase you make from us. Please read them carefully. By using the Site or placing an order, you agree to these Terms.

1. Acceptance of terms

By browsing the Site, creating an order, or otherwise using our services, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site or place an order.

We may offer additional terms for specific features or promotions. Where those apply, they form part of these Terms, and if there is a conflict, the additional terms govern for that feature or promotion.

2. Eligibility

To place an order, you must be at least the age of majority in your province or territory of residence, or have the involvement of a parent or guardian who agrees to these Terms on your behalf. By ordering, you confirm that the information you provide is accurate and that you are authorized to use the payment method you select.

3. Products, descriptions, and colour accuracy

We take care to describe and photograph our coats, knitwear, coordinated sets, dresses, and leather handbags as accurately as possible. Even so, product images are for illustration.

• Colours may appear differently depending on your screen, settings, and lighting, so the exact shade you receive may vary slightly from what you see online.
• Natural leather and textiles can show small variations in grain, texture, and tone from piece to piece. These are characteristics of the material, not defects.
• Measurements and fit details are provided as a guide and may vary within normal manufacturing tolerances.

We do not warrant that product descriptions or other Site content are complete, current, or error-free. If an item you receive is not as described, please contact us so we can make it right.

4. Pricing and correction of errors

All prices are listed in Canadian dollars (CAD) and are exclusive of applicable taxes and shipping unless stated otherwise. Taxes and shipping, where they apply, are shown at checkout before you confirm your order.

We work hard to keep pricing and availability accurate, but errors can occur. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update prices, promotions, and availability at any time without prior notice. If an item's correct price is different from the price shown when you ordered, we will contact you before shipping so you can confirm the order at the correct price or cancel it for a full refund.

5. Orders and our right to refuse or cancel

Your order is an offer to purchase. All orders are subject to acceptance and to product availability. An order confirmation email acknowledges that we received your order; it does not guarantee acceptance.

We reserve the right to refuse, limit, or cancel any order at our discretion, including where:

• an item is out of stock or a listing contained a pricing or description error;
• we are unable to authorize or verify your payment;
• we suspect fraud, resale, or unauthorized or abusive activity; or
• the order breaches these Terms.

If we cancel an order after you have paid, we will refund the amount charged to your original payment method.

6. Payment

Payments are processed securely through Stripe, our third-party payment provider, using hosted checkout. Your card details are handled directly by Stripe and are never stored by BellaSublime. Your use of Stripe is subject to Stripe's own terms and privacy policy.

By submitting payment, you represent that you are authorized to use the chosen payment method and that all information you provide is true and complete. We reserve the right to hold or cancel an order if payment cannot be authorized.

7. Shipping and risk of loss

We ship Canada-wide. Shipping is a flat $12 CAD, and free on orders over $150 CAD. Local pickup is available. Orders typically ship within 1 to 2 business days; delivery timelines from the carrier are estimates and are not guaranteed.

Risk of loss and title for the items pass to you upon delivery to the address you provided, or upon collection for local pickup orders. You are responsible for providing a complete and accurate delivery address. Full details are set out on our Shipping & Returns page.

8. Returns and exchanges

We offer a 14-day return window on unworn items in original condition with tags attached. Refunds are issued to the original payment method, and exchanges are available. Please review our Shipping & Returns page for the complete process, eligibility conditions, and any exclusions. That page forms part of these Terms.

9. Promotions and discount codes

From time to time we may offer promotions, sales, or discount codes. Unless we state otherwise:

• codes must be applied at checkout and cannot be added after an order is placed;
• only one code may be used per order, and codes cannot be combined;
• codes have no cash value, are non-transferable, and cannot be exchanged for cash or store credit;
• promotions may be limited in time or quantity and may be changed or withdrawn at any time; and
• we may cancel an order or a discount if a code is used in a way that breaches these Terms or the promotion's stated conditions.

10. Intellectual property

All content on the Site, including text, product photography and images, graphics, logos, the BellaSublime name, page layouts, and their selection and arrangement, is owned by BellaSublime or its licensors and is protected by Canadian and international intellectual property laws.

You may view and use the Site for your own personal, non-commercial shopping purposes. You may not copy, reproduce, republish, distribute, modify, or use any Site content for commercial purposes without our prior written permission.

11. Acceptable use

When using the Site, you agree not to:

• use the Site for any unlawful, fraudulent, or harmful purpose;
• attempt to gain unauthorized access to the Site, our systems, or other users' accounts;
• interfere with or disrupt the Site, including by introducing malware or overloading our infrastructure;
• scrape, harvest, or collect data from the Site using automated means without our permission; or
• infringe our intellectual property or the rights of others.

We may suspend or restrict access to the Site for anyone who breaches these Terms.

12. Disclaimers and limitation of liability

The Site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties that are not expressly stated in these Terms, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the Site will be uninterrupted, secure, or error-free.

To the fullest extent permitted by applicable law, BellaSublime and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or from any product purchased. Where our liability cannot be excluded, it is limited to the amount you paid for the product giving rise to the claim.

Nothing in these Terms limits or excludes any rights or remedies you have under applicable consumer protection laws, including the Consumer Protection Act (Québec) and other laws that cannot be waived or restricted by agreement.

13. Indemnification

You agree to indemnify and hold harmless BellaSublime and its owners, employees, and suppliers from any claims, losses, liabilities, and reasonable expenses (including legal fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or the rights of a third party. This does not apply to matters caused by our own negligence or wrongdoing, or to rights that cannot be limited under applicable law.

14. Governing law

These Terms and any dispute relating to them or to your use of the Site are governed by the laws of the Province of Québec and the federal laws of Canada that apply there, without regard to conflict-of-law rules. Subject to any mandatory consumer protection rights that apply where you live, you agree that the courts located in Québec have jurisdiction over any such dispute.

15. Changes to these terms

We may update these Terms from time to time to reflect changes in our practices or in the law. When we do, we will revise the "last updated" date above. Changes take effect when posted, and your continued use of the Site or placement of a new order after that means you accept the updated Terms. Orders already placed are governed by the Terms in effect when you ordered.
